These Terms of Service are an agreement between you and Swing Labs Group Pty Ltd ("we", "us") for your use of the Butler: Household Assistant app ("Butler") on iPhone and iPad and of the Butler subscription. You accept these terms when you confirm them in the app. If you start a trial, subscribe or keep using the app, you also accept them. Our Privacy Policy explains how we handle personal information.

Your Apple licence

Your licence to use the app is granted under Apple's Standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula). These terms add to that agreement. They are between you and us, not Apple. The licence is personal and non-transferable, and lets you use Butler on Apple devices you own or control, as Apple's terms allow.

We, not Apple, are responsible for Butler, its content, its maintenance and support, and for any claim about it, including product liability, consumer protection, privacy, legal compliance and intellectual property claims. If Butler fails to meet an applicable warranty, you may notify Apple, which may refund the price you paid for the app; beyond that, Apple has no warranty obligation. Where Apple's licence describes the app as provided "as is", limits liability or applies another country's law, those terms apply only as far as the Australian Consumer Law and other mandatory laws allow.

You confirm that you are not located in a country subject to a United States Government embargo and are not on a United States Government list of prohibited or restricted parties. You must also follow any third-party terms that apply when you use Butler, such as your mobile or internet provider's terms. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Who can use Butler

You must be at least 18 years old to use Butler. Butler is for adults managing a household. Family profiles are records, not accounts for children. Only add, upload or share information you are entitled to use, respect the privacy of household members and helpers, and keep access to your device secure. Do not use Butler for unlawful purposes, harassment, fraud or abuse, do not try to get around its security, subscription or usage limits, and do not upload malicious content. When you use Butler AI, you must also follow the usage policies of our AI provider, which prohibit, for example, illegal, harmful or abusive requests.

What Butler does

Butler organises plans, lists and documents on your device. Butler can suggest changes, using Butler AI when you have allowed it and simple matching on your device otherwise. Either can misread dates, names or instructions, so review each suggestion before confirming it. Replies and suggestions from Butler AI are generated by artificial intelligence and are marked as such in the app. A suggestion does not book an appointment, contact anyone, pay a bill or change another calendar. A shared day or list is a snapshot, not live collaboration.

Reminders depend on your permission, your device settings and the operating system. Check important or time-critical commitments yourself. Butler is not an emergency service, a medical device, or a source of medical, legal or financial advice.

Your subscription

Butler is an auto-renewing subscription billed by Apple to your Apple Account: A$9.99 per month or A$79.99 per year, including GST. The price shown in the App Store when you subscribe applies. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. If the price changes, Apple tells you beforehand and, where required, asks you to agree; you can cancel before the new price applies. Your subscription works on every iPhone and iPad signed in with the same Apple Account, but your household is stored on each device separately; use export to move it.

Free trial

Eligible new subscribers can start a 7-day free trial, once per Apple Account. If you do not cancel at least 24 hours before the trial ends, your paid subscription starts automatically and Apple charges the price of the plan you chose. Butler reminds you in the app during the last two days of your trial and, if you allow notifications, the day before it ends.

Cancelling and refunds

You can cancel at any time in your device's Settings, under your name and then Subscriptions, or from Settings in Butler. Cancelling takes effect at the end of the current trial or paid period, and you keep full access until then. Deleting Butler or your household does not cancel a subscription by itself. Refunds for App Store purchases are requested from Apple at reportaproblem.apple.com. This does not limit your rights under the Australian Consumer Law, and you can always contact us.

Without a subscription

Without an active trial or subscription, Butler is read-only. You can still open and view your household, read saved items, search, export your household and delete it. You cannot add, change, complete or remove individual items, import documents or use Butler AI. Your household is not deleted when a subscription ends, and export and deletion are always available.

Butler AI

Butler AI is included with an active trial or subscription and only works after you allow it in the app. To keep it fair and affordable, Butler AI currently allows up to 60 messages a day per device. Butler AI can occasionally be unavailable, for example during maintenance or a problem with our AI provider; Butler's other features keep working. We may suspend Butler AI for a device only for a genuine security threat, misuse in breach of these terms or a legal requirement, in proportion and with an explanation where we can lawfully give one.

Your content

Your household content stays yours. We use it only to provide the features you ask for, as explained in our Privacy Policy. You choose whether to send something to Butler AI and whether to share a snapshot or an export.

Our app

We own Butler and its content. You receive a personal, non-transferable licence to use it under Apple's licence and these terms.

Changes to Butler and these terms

We may change these terms or the subscription's features for legitimate reasons, such as changes in the law, security needs or improvements to Butler. We will tell you in the app at least 30 days before a material change takes effect. If you do not agree, you can cancel before the change applies. Changes never apply to the past. Price changes follow Apple's notice and consent process.

Ending these terms

You can stop using Butler and cancel your subscription at any time. We may end your access to the subscription only for a serious or repeated breach of these terms, or if we stop offering Butler. If we stop offering the subscription for any other reason, we will give you at least 30 days' notice, and you will still be able to export and delete your household.

Our responsibility

To the extent permitted by law, and except for liability that cannot be excluded under the Australian Consumer Law:
- we are not liable for any loss caused by information you enter, by a suggestion you confirm without checking it, by a reminder that is not delivered because of your device settings or operating system, or by the loss of data you did not export;
- we are not liable for any loss caused by events outside our reasonable control, such as outages of Apple, our hosting or AI providers, or your internet connection; and
- we are not liable for any indirect loss that was not reasonably foreseeable.
Nothing in these terms limits our liability for our own negligence, fraud or wilful misconduct.

Your consumer rights

Nothing in these terms excludes, restricts or modifies the consumer guarantees or any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded. We do not ask you to waive your rights, give an unlimited indemnity or accept mandatory arbitration. We do not promise that AI is always accurate, that reminders always arrive or that any software is completely secure; saying so does not reduce our legal responsibilities.

Other terms

Transfer. We may transfer our rights and obligations under these terms to another company that takes over Butler, as long as your rights are not reduced. You cannot transfer these terms to someone else.
If part of these terms is invalid. If a court finds any part of these terms invalid or unenforceable, that part is removed and the rest continues to apply.
Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control. We will tell you about them where we can and do our best to keep Butler working.
No waiver. If we do not enforce a term straight away, we can still enforce it later.

Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction. Nothing in this clause limits your right to complain to a consumer protection agency or to bring a claim in a court or tribunal where you live.
